Regulamin  DTPROPELLER

The given Regulations of DTpropeller specify, among other things, the rules for the conclusion of sales contracts through the DTpropeller website, including the most significant information about the Seller, the DTpropeller website and the rights of the Consumer.

The Priority (preferential) Entrepreneur provisions shall be applicable to contracts signed on or after 10 November 2022.

  • 2 ORDER PROCESSING

The seller is bound to deliver the goods without any defects.

If the goods are in stock, then shipment to the customer takes place the next day after the payment is made. If the goods are not in stock, the delivery time is 4-7 working days. Production time depends on the complexity of the product.

The lead time for each order is indicated in the order confirmation email.

The advanced payment for the ordered goods is 100%, the Seller will proceed with the execution of the order after its payment.

In a situation where the Buyer has purchased goods with different lead time within one order, the order will be fulfilled within the time limit applicable to the goods with the longest lead time.

The goods manufactured by the DTpropeller are sent by post or courier to many countries of the world (refer to the manufacturer).

The goods ordered on the Dtpropeller website are delivered depending on the delivery method chosen by the Buyer:

  1. By courier service
  2. By the Polish Post Office

The Buyer may collect the goods himself at the company’s premises during its opening hours.

If the Buyer chooses to collect the goods himself, the goods will be ready for collection on the indicated order completion date, and if the Seller has indicated a date of sending the

goods – on that date.

  • 3 RIGHT OF WITHDRAWAL

(1) The Priority Buyer shall have the right to withdraw the contract concluded with the Seller through the DTpropeller website, subject to § 4 of the Regulations, within 14 days without giving any reason.

(2) The period to withdraw the contract shall expire 14 days from the day:

  1. on which the Priority Buyer has taken possession of the goods or on which a third party other than the carrier and indicated by the Priority Buyer has taken possession of the goods;
  2. on which the Priority Buyer has taken possession of the last of the goods or on which a third party, other than the carrier and indicated by the Priority Buyer, has taken possession of the last of the goods if the contract involves the transfer of ownership of multiple goods which are delivered separately;
  3. of the contract conclusion – in the case of a contract for the supply of digital content.

(3) In order for a Priority Buyer to exercise his right of withdrawal, he is bound to inform the Seller, using the data provided in § 1 of the Regulations, of his decision to withdraw the contract by means of an unambiguous statement (for example, a letter sent by post or information provided by e-mail).

(4) In order to observe the terms of withdrawal it is sufficient for the Priority Buyer to send information concerning the exercise of his right of withdrawal before the withdrawal period has expired. EFFECTS OF WITHDRAWAL FROM THE CONTRACT

(5) In the event of withdrawal from the concluded contract, the Seller shall reimburse to the Priority Buyer all payments received from the Priority Buyer, including the costs of delivery of the goods (except for the additional costs resulting from the method of delivery chosen by the Priority Buyer other than the cheapest ordinary method of delivery offered by the Seller), immediately and in any event not later than 14 days from the day on which the Seller was informed of the decision of the Priority Buyer to exercise his right of withdrawal.

(6) The Seller shall reimburse the payment using the same payment methods that were used by the Priority Buyer in the initial transaction, unless the Priority Buyer agrees otherwise, in any case the Priority Buyer shall not incur any fees in connection with such reimbursement.

(7) The Seller may withhold reimbursement until he receives the goods or until he is provided with the proof of return, whichever occurs first.

(8) The Seller requests that the goods be returned to the following address: 19 Spożywcza Street, 16-010 Wasilków, Poland immediately, and in any case no later than 14 days from the day on which the Priority Buyer informed the Seller about the withdrawal from the sales contract. The time limit shall be observed if the Priority Buyer sends back the goods before the 14-day period expires.

(9) The Priority Buyer shall bear the direct costs of returning the goods.

(10) The Priority Buyer shall only be liable for any diminution in the value of the goods resulting from the use of the goods in a manner other than was necessary to ascertain the nature, characteristics and functioning of the goods.

(11) If the goods, due to their nature, cannot be dispatched by ordinary post, the Priority Buyer shall also have to bear the direct costs of returning the goods. The Priority Buyer is informed of the estimated amount of these costs by the Seller in the description of the goods on the website or when placing the order.

(12) In the event that a refund is required for a transaction made by the Priority Buyer with a payment card, the Seller will reimburse the funds to the bank account assigned to that payment card.

  • 4 RIGHT OF WITHDRAWAL EXCEPTIONS

(1) The right of withdrawal from a contract concluded at a distance, referred to in § 3 of the Regulations, shall not apply to a contract:

  1. in which the object of the service is a non-prefabricated item produced according to the specifications of the Priority Buyer or aimed to satisfy his personalised needs;
  2. in which the object of the service is an item supplied in a sealed package which cannot be returned after opening the package for health protection or hygienic reasons, if the package has been opened after delivery;
  3. in which the object of the service is an item which, after delivery, by its nature becomes inseparable from other items;
  4. carts delivered at the customer’s request are non-returnable and the fee for completing the cart is non-refundable.
  • 5 RECLAMATION

(1) In the event of a defect in the goods, the Consumer has the right to complain about the defective goods on the basis of the warranty or guarantee stipulated in the Civil Code, if the guarantee has been granted.

(2) Using the warranty, the Consumer may, under the terms and conditions of the Civil Code:

  1. place a claim for a price reduction,
  2. in the case of a significant defect – make a statement on withdrawal from the contract,
  3. demand replacement of the item with a defect-free one,
  4. demand defect removal.

(3) The Seller asks to submit claims under the warranty to the postal or e-mail address given in § 1 of the Regulations.

(4) If it turns out that in order to consider the claim it is necessary to deliver the defective goods to the Seller, the Consumer is obliged to deliver the goods at the expense of the Seller, to the address 19 Spożywcza Street, 16-010 Wasilków, Poland

(5) If the goods were additionally provided with a warranty, information about it, as well as about its terms and conditions, is available in the product description on the website.

(6) Complaints about the operation of the website should be sent to the e-mail address specified in § 1 of the Regulations.

(7) The Seller will consider the claims within 14 days. OUT-OF-COURT WAYS OF DEALING WITH COMPLAINTS AND ASSERTION OF CLAIMS

(8) In case the complaint procedure does not bring the result expected by the Consumer, the Consumer inter alios may use:

  1. mediation conducted by the competent Provincial Inspectorate of Trade Inspection, to which one should apply for mediation. As a rule, the procedure is free of charge. The list of inspectorates can be found here: https://www.uokik.gov.pl/wazne_adresy.php#faq595;
  2. the assistance of the competent territorial permanent consumer arbitration court functioning at the Provincial Inspectorate of Trade Inspection, to which a request for consideration of the case shall be submitted before the arbitration court.   3. free assistance from a city or county consumer advocate;
  4. online ODR platform available at: https://ec.europa.eu/consumers/odr/main/?event=main.home.howitworks.
  • 6 PERSONAL DATA
  1. The Seller is the administrator of the personal data provided by the Buyer when using the DTpropeller website.
  2. The Seller processes the data, provided by the Buyer in connection with purchases in the shop, with the purpose of orders execution. The basis for the processing of personal data in this case is:
  • the contract or actions taken at the request of the Buyer to conclude it (Article 6 (1)(b) GDPR),
  • the Seller’s legal obligation related to accounting (Article 6 (1)(c) and
  • the Seller’s legitimate interest, consisting in the processing of data for the purpose of establishing, pursuing or defending possible claims (Article 6 (1)(f) GDPR).
  1. The provision of data by the Buyer is voluntary, but at the same time necessary for the conclusion of the contract. Failure to provide data will prevent the conclusion of a contract on the DTpropeller website.
  2. The Buyer’s data provided in connection with purchases on the DTpropeller website will be processed until:

1) the contract concluded between the Buyer and the Seller ceases to be in force;

2) there ceases to be a legal obligation on the Seller to process the Buyer’s data;

3) the possibility to assert claims by the Buyer or Seller related to the contract concluded through the DTpropeller website ceases;

4) the Buyer’s objection to the processing of his personal data is accepted – if the basis of the data processing was the legitimate interest of the Seller

– depending on what is applicable in the particular case and what happens at the latest.

The buyer has the right to request:

  • access to his personal data,
  • correction,
  • deletion,
  • restriction of processing,
  • transfer of data to another administrator, as well as the right to:
  • object at any time to the processing of data for reasons related to the Buyer’s particular situation – to the processing of personal data concerning him, based on Article 6 (1)(f) GDPR (i.e. on legitimate interests pursued by the administrator).
  1. In order to exercise their rights, the Buyer should contact the Seller using the data from § 1 of the Regulations.
  2. If the Buyer considers that his data are processed illegally, the Buyer may lodge a complaint with the President of the Office for Personal Data Protection.
  • 7 DISCLAIMER
  1. It is prohibited for the Buyer to provide unlawful content.
  2. Each order placed on the DTpropeller website constitutes a separate sales contract and requires separate acceptance of the Regulations. The contract is concluded for the time and for the purpose to execute the order.
  3. Contracts concluded on the basis of the Regulations are concluded in Polish and English.
  4. In the event of a possible dispute with a Buyer who is not a Priority Buyer, the competent court will be the court having jurisdiction over the Seller’s registered office.
  5. Any liability of the Seller in relation to the Buyer who is not a Priority Buyer, within the limits permitted by law, is excluded.
  6. Liability under the warranty against a Priority Buyer is excluded.
  7. The provisions relating to the goods and the sales contract shall be applied correspondingly to the digital content and the contract for the supply of digital content, unless the Regulations stipulate these issues separately.

Delivery terms and conditons

The delivery and package are not included in the price of the propeller and are paid extra. Shipping charges are calculated on the basis of the weight, size of ordered products and country of destination.

All international parcels are shipped via tracked Priority Mail.

The average delivery time for propellers is 5-7 days.

Our package (double boxes made of five-layer corrugated cardboard) is safe and protects propellers from damage. We secure additionally tips of blades by extruded polystyrene foam.

Return policy: propellers

  • All returns and exchanges must be authorized. Please email us at office@dtpropeller.com
  • All writing claims must be placed within 14 working days of receipt of goods.
  • All goods must be returned within 14 working days of purchase.
  • Returned goods must be in the original packaging.
  • Defects of propellers must not be due to misuse, accidents, shocks, poor take off, flying or landing technique and so on.

Return policy: trikes

All trikes are customized. Thus, they are not subject to return.

In case of reclamation, please contact us via email office@dtpropeller.com and provide us with full description of the issue accompanied by high-resolution photos.

In case of a manufacturing defect or of an error/omission of the factory, all modifications and relative shipping charges are at DTpropeller’s expenses.

In case of an error/omission of the client, of inaccurate measurements provided by client or other issues due to improper operation, all modifications and relative shipping charges are at client’s expenses.
